Michigan law prohibits surrogacy contracts, agreements, or arrangements where the surrogate receives a fee or other compensation. Michigan law also declares any such contract void and unenforceable. Despite these limitations, compassionate surrogacy arrangements are not illegal and take place usually involving relatives or close friends of the intended parents. Most surrogacy arrangements use a gestational carrier where one or both of the intended parents are the biological parents of the child to be born to the surrogate. In these situations a prebirth order is sought determining the parentage of the child prior to delivery.
